LIBERIA: Defense Lawyer Files Motion To Dismiss Case Against Top Police Brass

(LINA) – The Defense lawyer in the case involving Police Chief of Public Safety, John Saah, along with three others accused of assaulting Police officer Mark Kardamine, has filed a motion to dismiss the casefor prosecution’s failure to proceed with the matter against the defendants.
A writ of arrest was issued against the defendants following a complaint filed against them by officer Kardamine alleging that in March 2018 Chief for Public Safety Saah ordered three men in persons of Kias Simpson, Chris Doe, and McCuley to be identified, to flog and drag him after an argument which ensued between them.
The complainant in the process sustained serious bodily wound.
But the case was transferred to Criminal Court “A” on grounds that the Monrovia City Court lacks jurisdiction over such a case.
However, since the case was transferred prosecution lawyers have not indicted the defendants nor tried them, prompting defence counsel to file the motion to dismiss the case against the defendants for failure to proceed.
Defense stated that for more than one term of court the defendants have not been indicted or tried for the crime allegedly committed without good cause as shown in Section 18: 2 of the Criminal Procedure Law.
They further indicated in their motion that prosecution has willingly failed to proceed with the indictment or trial of the case.
