Amb. Osman Dukuly finds Fault With Judges; J. Vinton Holder And Lamin Quiqui Gbeisay

According to Probate Court documents in the possession of GNNLiberia, the Momolu Dukuly Testate Estate was closed on December 5, 1988 by then-Probate Court Judge, His Honour, the late Harper S. Bailey, acting upon a mandate of the Supreme Court of the Republic of Liberia to have said Testate Estate closed.

Ambassador Dukuly in the court’s record finds fault with several judges including His Honour Judge J. Vinton Holder, of the Probate Court for Montserrado County, and Judge Lamin Quiqui Gbeisay, then Assigned Probate Court Judge His Honour Yami Quiqui Gbeisay, Sr.

Court’s records show the following documents:

1. Supreme Court mandate to have the Estate closed

2. Petition for the closure of the said Estate

3. AFFIDAVID to the PETITION

4. NOTICE by the Probate Court for the filing of LEGAL OBJECTIONS to the PROBATION AND REGISTRATION OF THE LAST WILL AND TESTAMENT OF THE LATE MOMOLU DUKULY

5. COURT’S DECREE DECLARING THE ESTATE CLOSED

(a) Paragraph three (3) of the DECREE states: IT IS HEREBY FURTHER ORDERED AND DECREED: “That the said Executrices be and are relieved of all and further responsibilities as such Executrices in keeping with Law.”

6. JUDICIAL NOTICE:

TO: ALL WHOM IT MAY CONCERN

FROM: HARPER S. BAILEY

PROBATE JUDGE, MO. CO., R.L.

SUBJECT: THE TESTATE ESTATE OF THE LATE MOMOLU DUKULY

announcing to all Lessees; Renters; and Customers that the Objection had been “adjudicated in favour of the Objector Osman Dukuly on December 5, 1988”, and that the said Testate Estate was thereafter closed.

Court’s records also show that, despite the closure of the Momolu Dukuly Testate Estate, Probate Court Judge J. Vinton Holder, in September, 2013, issued LETTERS TESTAMENTARY to one of the late Momolu Dukuly’s heirs as Executrix to manage the said Testate Estate, 25 years after its closure.

Court’s records further show that, on December 18, 2015, – 27 years later  – then-Assigned Probate Court Judge, His Honour Yamie Quiqui Gbeisay, Sr issued EXTENDED LETTERS TESTAMENTARY to the same heir as an Executrix to manage the said Momolu Dukuly Testate Estate, 27 years after its closure

According to Amb. Dukuly, some of the properties belonging to the late Momolu Dukuly heirs have been illegally leased to Rashpaul Singh (Paul Sethi) and Sons, and others using the fraudulent LETTERS TESTAMENTARY.

The DECREE closing the Momolu Dukuly Testate Estate on December 5, 1988, was signed by then-Probate Court Judge Harper S. Bailey, and attested to by Ellen Hall, then-Clerk of said Court, now Ellen Hall Kamara, Clerk of the Civil Law Court, at the Temple of Justice, Monrovia, Liberia.

The Court’s file even contains a letter to Judge Holder, from Cllr. Frank Musah Dean Jr., Informing Judge Holder that the Momolu Dukuly Testate Estate was closed, when Cllr. Dean briefly served as legal counsel to Amb. Dukuly
