Supreme Court Justice-in- Chamber, Yussif D. Kaba, on Monday issued an Alternative Writ following the filing of a Petition for a Writ of Certiorari from Roots FM’s lawyer, Cllr. Tiawon Gongloe, consistent with Chapter 16, Section 16.21 of the Civil Procedure Law of Liberia.
The intent of Cllr. Gongloe’s application to the Justice-in-Chamber is to review and correct Judge Roosevelt Willie’s alleged interlocutory judgment against his client.
The Justice’s January 2, 2020 action has reopened the legal battle at the high level between Montserrado County Chief Prosecutor, Cllr. Edwin Martin and LNBA prexy Gongloe.
On November 15, 2019, Judge Juma Jallah was ordered by Criminal Court Presiding Judge Roosevelt Willie to reopen the trial fresh between Roots FM Management and the Government of Liberia after then Magistrate Ernest Bana was relieved of his position by President George Weah last year following the appointment of Judge Jallah.
But immediately after Judge Willie ruling, Monrovia City Court Presiding Judge Jallah hearing of the criminal trial between Roots FM Management and Government of Liberia at Monrovia City Court remains uncertain.
Judge Jumah is far from reopening this legal matter due to a stay order from Associate Justice Yussif Kaba who is currently presiding in chamber at the Supreme Court.
It can be re-called that on Thursday, October 10, the Monrovia City Court issued a search and seizure warrant against Roots FM 102.7 for operating without a valid license, as well as illegally using its broadcast equipment to tarnish the good character of the government and its officials.
Upon issuance of the search and seizure warrant, heavily armed officers of the Liberia National Police moved on the premises of Roots FM 102.7 to effect the closure of the radio station.
Meanwhile, the case is still pending before Judge Jallah awaiting trial.
