Former Associate Justice of the Supreme County of Liberia has filed a lawsuit against the Liberian Government at the ECOWAS Court for what he termed his ‘illegal removal’ from the Bench of the Court by a group of pro-government legislators.
Speaking to James Butty of the of the Voice of America (VOA) on Day Break Africa morning program, the former Associate Justice, Kabineh M. Ja’neh said his move to file a formal complaint to the ECOWAS regional court is to seek redress for his illegal removal from the Supreme Court Bench as Associate Justice, and further vowed to press forward.
In 2018, Representative Moses Acarous Gray, a staunch member of the ruling Coalition for Democratic Change (CDC) and who is representing Montserrado County District 8 for the second time in the Legislature, proposed at the early stage the impeachment of Justice Ja’neh, few weeks some of his colleagues from the same political party joined him.
He was in August 2018 impeached by the House of Representatives over four counts ranging from abuse of judicial power, theft of property, among others. Following his impeachment by the Lower House, the matter was forwarded to the Senate for trial, and subsequently removal or acquittal based on the procedures guarded by due process of law.
The entire proceedings at the Senate were entertained by testimonies from witnesses and presentation of pieces of evidence from both parties. The embattled former Associate himself took the stand and pleaded not guilty to all the charges they levied against him.
But justifying his reason for issuing a lawsuit at the ECOWAS, the former Associate Justice told the Voice of America that he will do all legally to restore his rights and privileges, noting that he was unconstitutionally removed.
