Lawyers representing embattle National Elections Commission Chairperson Davidetta Brown-Lassanah questions the legal authority of LACC to render judgment on violation of National Code of Conduct for public officials

During legal argument Thursday in a motion to dismiss the indictment filed by the defense counsel, Chairperson Brown Lanssanah’s lawyers stated the office of the ombudsman is responsible by law to investigate violators of the Code of Conduct; and, if found guilty of criminal offenses, they recommend said criminal to the LACC.

They noted that Inside trading which is one of the counts of indictment against Madam Brown Lansanah has not been penalized under Liberia’s penal law and others statutes as such; the NEC Chairperson cannot be made to answer to the LACC investigation which is in violation of the statute that established the ombudsman.

The lawyers’ of the NEC Chair however prayed the court to dismiss the indictment against the Elections Commission Boss, as the LACC lacks legal power to indict in the absence of the office of the ombudsman.
