CNDR filed an excuse in subpoena duce tecum and Ad testificandum to search records to appear Monday

(LINA) – The Center for National Documentation and Records Agency have filed an excuse to enable them search the records to produced, confirmed and testified to the registration of the three Administrative deeds issued by the Bettie’s estate to the MDCM, following a subpoena duce tecum and Ad testificandum served on them.
A Subpoena Duces Tecum Ad Testificandum is a jumbo subpoena that combines two qualities or characteristics namely: commanding or ordering a person to appear and bring specified documents or records and to give testimony.
It” has come to their attention that the subpoena witness filed with this court an excuse pursuant of the service of the subpoena requesting this court for leave of absent to appear on Monday, January 16, 2023 in compliance to the subpoena.
Accordingly said subpoena was served on January 11, 2023 and by the nature of order they are required to search the records for three administrators’ deeds in respond to the subpoena that it may take up to three days to diligently search their records since the deeds do have volumes and pages, Plaintiff lawyers indicated.
Based upon the excuse filed by CNDR, Civil Law Court “B” Judge Ousman F. Feika said that this court notes that the CNDR was to appear today as a subpoena witness to testify in these proceeding, said CNDR having requested an excuse to appear on Monday, this trial continue tomorrow Friday same being January 13, 2023 at the hour of 9:00am.
It can be re-call that the manager and CEO of the Modern Development Management Corporation Mr. John Youboty filed an action of ejectment against twelve persons to recovery a piece of property in the Mount Barclay area which he alleged that said defendants have trespassed.
The MDMC case is currently before the Civil Law Court “B” on an action of Ejectment, where twelve men are facing trial.
Mr. John Youboty is the manager and CEO of the Modern Development Management Corporation upon which, said company owns seventeen acres in the Mount Barclay community which they bought from the Bettie family since 2013.
But to their surprise twelve men who are currently facing trial, criminally trespass said properties, that doesn’t belong to them, for which MDMC filed and action of ejectment against them.
